This is a petition for grant of anticipatory bail for offence under Sections 272 and 273 of the Indian Penal Code and 47(a) and 47(g) of the Bihar Excise (Amendment) Act, 2016. From the back side of the house of the petitioner country made liquor was allegedly recovered.
Submission of the petitioner is that the petitioner has enmity with the Dafadar and due to that grudge a false case has been filed against the petitioner. The petitioner has got no criminal antecedent.
Considering the aforesaid fact, the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Barauli P.S. Case No. 194 of 2016 to the satisfaction of the Chief Judicial Magistrate, Gopalganj, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
