JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-01-2018 Heard learned counsel for the petitioner and the counsel appearing on behalf of the State.
Petitioner is seeking bail in connection with Baligaon P.S. Case No. 01 of 2012 for an offence under sections 328 and 302 of the Indian Penal Code.
Learned counsel for the petitioner submits that after investigation, police has submitted charge-sheet under section 306 of the Indian Penal Code. He further submits that the husband of the deceased has been granted bail by this court in Cr. Misc. No. 10282 of 2013 dated 12.4.2013 (Annexure-2).
In view of the fact that the husband of the deceased was granted bail vide order dated 12.4.2013 in Cr. Misc. No. 10282 of 2013, the petitioner, namely, Shiv Chandra Rai @
Patna High Court Cr.Misc. No.63435 of 2017 (2) dt.10-01-2018 2/2 Dhodha Rai who is father-in-law of the deceased is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each or any other surety to be fixed by the court concerned to the satisfaction of learned Additional Chief Judicial Magistrate-12th, Vaishali at Hajipur in connection with Baligaon P.S. Case No. 01 of 2012 , subject to the conditions (i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner.
The bailor will undertake to furnish information to the Court about any change in address of the petitioner, (ii) That the petitioner will give an undertaking that he will receive the police papers on the given date and be present on date fixed for charge and if he fails to do so on two given dates and delays the trial in any manner, his bail will be liable to be cancelled for reasons of misuse, (iii) That the petitioner will be well represented on each date if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
