The petitioner seeks bail in a case registered under Sections 399, 402, 413 and 414 of the Indian Penal Code and 25(1-B)A, 26 and 35 of the Arms Act.

Allegedly, the informant raided the place of occurrence and apprehended four miscreants. A loaded country made pistol was found on the ground.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 19-02-2019. Charge sheet has already been submitted. One mobile is said to have been recovered from possession of the petitioner. The said mobile

Patna High Court CR. MISC. No.41445 of 2019(2) dt.05-07-2019 2/2 belongs to the petitiner. No fire arms is alleged to have been recovered from possession of the petitioner. The other coaccused with similar allegation have been granted bail by coordinate benches of this court vide orders dated 10-04-2019 & 28-05-2019 passed in Cr. Misc. Nos. 22857 of 2019 and 636 of 2019.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gopalganj in connection with Thawe P.S. Case No. 26 of 2019.
