2. The petitioner apprehends her arrest in a case registered for the offences punishable under Sections 341, 323, 504, 506, 379, 307/34 of the I.P.C.
3. As per the prosecution case, the F.I.R. has been lodged against nine named accused persons including the present petitioner. The allegation against the petitioner along with eight others is to assault the informant and his family by fist and brick. Further allegation of snatching of mobile is also there in the F.I.R.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He submits that a general and omnibus allegation is there against the petitioner in the F.I.R. He further submits that the informant's
Patna High Court CR. MISC. No.54935 of 2024(2) dt.07-08-2024 2/2 side and petitioner's side both are resident of same village and same police station. They are well known to each other. From the contents of the F.I.R., it becomes very much clear that there are existing land dispute going on between them. He further submits that for the same date and place of occurrence, there are case and counter case lodged from both the sides. Chanan P.S. Case No. 142 of 2023 has been lodged against the informant and others, as well as Chanan P.S. Case No. 143 of 2023 has been lodged by the present informant, who is accused in case filed by the petitioner.
5. Learned A.P.P. for the State opposes the prayer for bail.
6. In the present facts and circumstances of the case and the submissions made above, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bonds of Rs.30,000/- (Rupees Thirty Thousand Only) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Lakhisarai in connection with Chanan P.S. Case No. 143 of 2023, dated 22.11.2023 subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dr. Anshuman, J) sadique/- U T
