JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-01-2016 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 467, 468, 406, 408, 409, 420, 120B, 109 of the Indian Penal Code and 7 of the Essential Commodities Act.

The prosecution case is of misappropriation of grains from June, 1997 to July, 2000, supplied for being distributed to the red card holders. It appears that earlier the petitioner's application for bail was withdrawn vide Cr. Misc. No. 9292 of 2006 and thereafter rejected vide Cr. Misc. No. 25313 of 2007.

It is submitted by the learned counsel for the petitioner that though the petitioner's earlier bail application was rejected, out of 72 persons named in the F.I.R., several have been granted anticipatory and regular bail by different

Patna High Court Cr.Misc. No.57916 of 2015 (2) dt.04-01-2016 Benches of this Court.

Let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Sursand P.S. Case No. 88 of 2000, pending in the court of learned Sub-Divisional Judicial Magistrate, Pupari, Sitamarhi.

With the above observation this application is disposed of.
