Petitioner is apprehending his arrest in a case registered for the offences punishable under Section 392 of the Indian Penal Code.

It is alleged that the petitioner being Auto-rickshaw driver in which the informant was travelling, called through mobile, when Chhotu Chaudhary robbed Rs. 5500/- from the pocket of informant.

It is submitted by the learned counsel for the petitioner that accusation is based only on suspicion. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.

The aforesaid facts constitute ground for consideration of prayer for regular bail of the petitioner, if the

Patna High Court Cr.Misc. No.57926 of 2015 (2) dt.04-01-2016 petitioner surrenders before the learned court below within a period of six weeks from today in connection with Ballia P.S. Case No. 74 of 2015, pending in the court of learned Chief Judicial Magistrate, Begusarai.

With this observation this application is disposed of.
