This application, for grant of anticipatory bail, arises out of Pupri P.S. Case No. 72 of 2016, disclosing offences under Sections 188, 353, 324, 225, 341 and 323 of the Indian Penal Code.
There are twenty six persons, named in the First
Patna High Court Cr.Misc. No.43009 of 2016 (2) dt.25-10-2016 2/3 Information Report and about 250 to 300 not named, who are said to have obstructed the police in effecting arrest of criminals. They are said to have got freed the said criminals, from the clutches of the police.
Learned counsel, appearing on behalf of the petitioners, has submitted that vague allegations have been made all the persons, named in the First Information Report. It has further been submitted that all the persons have been named in another case registered on the same day, in which they have been granted anticipatory bail.
Considering the submission, as above, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Pupri at Sitamarhi, in connection with Pupri P.S. Case No. 72 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as
Patna High Court Cr.Misc. No.43009 of 2016 (2) dt.25-10-2016 3/3 and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
