The petitioner has preferred this application for grant of regular bail in a case registered under section 392 of the Indian Penal Code to which section 412 of the Indian Penal Code was added subsequently.

As per the prosecution case, four accused persons on two motorcycles are said to have assaulted the informant and dispossessed him of his belongings including mobile phone, musical instrument etc.

It is submitted by learned counsel for the petitioner that the FIR was registered against four unknown. Referring to the order of the learned trial court, it is submitted that the name of the petitioner transpired in the confessional statement of coaccused Ajit Kumar made before police. No incriminating

Patna High Court CR. MISC. No.54455 of 2021(2) dt.05-04-2022 2/2 article has been recovered from the petitioner's possession. Inspite of being in custody since 9.7.2021, the petitioner has not been put on T.I. parade. Co-accused Ajit Kumar has himself been enlarged on bail vide order dated 10.2.2022 passed in Cr. Misc. no. 48298 of 2021.

Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the petitioner not having been put on T.I. parade inspite of being in custody for more than 8 months, chargesheet having been submitted in the case and grant of bail to co-accused Ajit Kumar, the petitioner is directed to be enlarged on bail in connection with Ujiyarpur P.S. Case no. 117 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Dalsinghsarai, District Samastipur.
