Petitioner seeks bail in Bhagwanpur Hat P.S. Case No.172 of 2018 instituted for the offence under Section(s) 392 Indian Penal Code and Section 27 of the Arms Act. Counsel for the petitioner submits that petitioner is not named in the First Information Report. No Test Identification Parade has been held. Nothing incriminating has been recovered from possession of the petitioner. During investigation, only on the basis of suspicion petitioner has been arrested and remanded in this case.

Petitioner is in custody since 24.08.2018 having clean antecedents.

In the facts and circumstances of the case, prayer of

Patna High Court Cr.Misc. No.71685 of 2018(4) dt.19-02-2019 2/2 the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, II, Siwan, in connection with Bhagwanpur Hat P.S.
