Petitioner, already in custody, seeks bail in connection with Desari (Sahdei) P.S. Case No.149 of 2014, registered under Sections 304B, 201, 120B and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner is in custody since 29.07.2015, some witnesses have not supported the case and earlier he had not moved for bail before this Court.
It appears that the trial is at the fag end and only three witnesses are to be examined, the Informant, the I.O. and the Doctor. The allegation is specific against the petitioner, so the prayer of bail of the petitioner is rejected in connection with
Patna High Court Cr.Misc. No.62709 of 2017 (2) dt.15-01-2018 2 /2 Desari (Sahdei) P.S. Case No.149 of 2014, pending in the court of learned Sessions Judge, Vaishali at Hajipur.
However, the trial court is directed to expedite the trial as only three witnesses are to be examined and preferably conclude the case on day to day basis within six months. Let a copy of this order be sent to the Superintendent of Police, Vaishali also for ensuring the production of witnesses on the day fixed.
