The petitioner apprehends his arrest in Dehri P.S. case No. 206 of 2015 under Section 414, 272, 273 of the Indian Penal Code and under Section 47(a) of the Excise Act. The police intercepted a vehicle and apprehended Madan Gond, driver of the vehicle, and from the vehicle 280 liters of country made liquor was recovered. Madan Gond disclosed that petitioner is the owner of vehicle.
The learned counsel for the petitioner submits that petitioner is not the owner of vehicle. The petitioner was not traveling in the vehicle nor any document is filed to show that petitioner is owner of the vehicle.
Considering the facts aforesaid and the nature of
Patna High Court Cr.Misc. No.55608 of 2016 (2) dt.13-01-2017 2/2 allegations made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Dehri in Dehri P.S. Case No. 206 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) BKS/- U T
