The petitioner apprehends his arrest in connection with Samastipur Muffasil P.S. Case No.344 of 2020, registered for the offences punishable under Sections 302, 201 and 34 of the Indian Penal Code as well as under Section 27 of the Arms Act. The FIR has been lodged against 11 named accused persons and 15-20 unnamed accused persons. It has been alleged in the FIR that the son of the informant was brutally assaulted and killed.

Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. The petitioner has got no criminal antecedent as stated in paragraph-3 of the bail petition. It is further submitted that there is general and omnibus allegation against the petitioner.

No.54669 of 2021(4) dt.22-06-2023 2/2 It is further submitted that the deceased had about 11 cases to his credit and, therefore, the possibility of his having been killed at the hands of the enemies cannot be ruled out. It is further submitted that similarly situated co-accused, Ravi Kumar Sharma @ Ravi Chandra Sharma has already been enlarged on anticipatory bail by a co-ordinate Bench of this Court vide order dated 15.04.2021, passed in Criminal Miscellaneous No.38044 of 2020. Learned APP for the State opposed the prayer for grant of anticipatory bail to the petitioner.

Taking into consideration the facts aforesaid, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Samastipur in connection with Samastipur Muffasil P.S. Case No.344 of 2020, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure. (Anjani Kumar Sharan, J) S.KUMAR/- U T
