2. The petitioner seeks bail in connection with Bihpur (Bhawanipur) P.S. Case No. 25 of 2023 registered for the offence under Sections 25(1-b)a, 25(8), 26 and Section 35 of the Arms Act.

3. As per the prosecution case, black color bag containing 400 live cartridges and a samsung mobile has been recovered from the possession of the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is in custody since 19.01.2023, the petitioner is quite innocent and has committed no offence.

5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. Considering the aforesaid facts and the period of custody, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Naugachia/concerned Court below in connection with Bihpur (Bhagwanpur) P.S. Case No. 25 of 2023 subject to condition that:- 7(i). The petitioner will mark his attendance at the Bibhutipur, Samstipur Police Station on first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
