Petitioner seeks bail in Dulhin Bazar P.S. Case No.170 of 2017 (Special Case No.175 of 2017) instituted for the offence under Section(s) 363, 363-A Indian Penal Code pending in the Court of the Additional Sessions Judge, 1st cum Special Judge, POCSO, Patna.
Prayer of the petitioner for bail was earlier rejected by this Court by order dated 06.11.2018 passed in Cr. Misc. No.41596 of 2018 with liberty to renew the prayer for bail after six months in the event no substantial progress is made in the trial.
Report has been received from the trial Court from
Patna High Court CR. MISC. No.42884 of 2019(3) dt.31-07-2019 2/2 which it appears that five witnesses have already been examined. Only doctor is left to be examined. The Trial Court has mentioned that trial is likely to be concluded within three months.
In such circumstances, this Court is not inclined to enlarge the petitioner on bail.
Prayer of the petitioner for grant of bail is rejected at this stage.
The trial Court is directed to expedite the trial and make all efforts to conclude the trial within a period of three months from the date of receipt of copy of this order as mentioned in the report.
