This is an application for grant of anticipatory bail in connection with Dighal Bank PS case no. 8 of 2017 registered for the offences punishable under Sections 420, 467, 463, 471, 472/34 of Indian Penal Code.
The allegation of the informant is that she had received a sum of Rs. 50,000/- under the Indira Awas Yojana and subsequently, she found that the petitioner herein, had withdrawn a sum of Rs. 49,000/-.
The learned counsel for the petitioner submits that there is no material to connect the petitioner with the alleged crime. It is further submitted that the petitioner is ready to join
Patna High Court Cr.Misc. No.62939 of 2017 (2) dt.11-01-2018 2/2 investigation.
Having regard to the facts and circumstances of the case, the abovenamed petitioner, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/ production of a copy of this order, is directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Kishanganj in connection with Dighalbank PS case no. 08 of 2017 subject to the conditions as laid down under Section 438(2) of Code of Criminal Procedure. The petitioner is further directed to join investigation and be present at the place as directed by the investigating agency. In case, the petitioner does not cooperate with the prosecution, the prosecution could move this Court for cancellation of bail of the petitioner.
