JUSTICE SANJAY PRIYA ORAL ORDER 3/ 19-02-2019 Heard learned counsel for the petitioner and learned APP for the State as well as counsel for the Informant. Petitioner seeks bail in Sahebpur Kamal P.S. Case No.220 of 2018 instituted for the offence under Section(s) 302, 201, 120-B/34 Indian Penal Code.

It is alleged in the written report filed by the Chaukidaar that one dead body of unknown female was recovered from the bush. First Information Report is against unknown.

During investigation, police recorded statement of brother of the deceased, who stated before the police that he had seen this petitioner and other accused persons moving near the college gate.

No.70789 of 2018(3) dt.19-02-2019 2/2 Counsel for the informant submits that on the basis of confession of Pramit, the dagger allegedly used in the occurrence has been recovered from the bush. Counsel for the informant has further submitted that as per para 64 two mobiles have been recovered from possession of the petitioner. Counsel for the petitioner submits that even from perusal of para 64, it will appear that only suspicion has been raised against him in the aforesaid paragraph. Petitioner is in custody since 24.07.2018.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-V cum Sub-Judge, Begusarai, in connection with Sahebpur Kamal P.S. Case No.220 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
