In the present case, petitioner is seeking relief for regularization of his service on the basis of the judgment of the Hon 'ble Supreme Court in the case of State of Haryana v. Piara Singh, reported in AIR 1992 SC 2131.

In the year 2004 an advertisement was made for empanelment. As per State petitioner had not applied and he was not empanelled. The panel has already exhausted. In such view of the matter, this Court gives direction to the concerned authority that whenever there will be a fresh advertisement in terms of the Bihar Group D (Recruitment

Patna High Court CWJC No.17035 of 2008 (10) dt.05-01-2018 and Service Condition) Rules, 2010 the petitioner will be at liberty to apply for the post and if he is found fit his case will also be considered for appointment.

With the aforesaid observation and direction this writ petition is disposed of.
