JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-01-2018 Earlier prayer for bail of the petitioner was rejected vide order dated 07.04.2017 passed in Cr. Misc. No. 10215 of 2017, with a direction to the trial court to expedite the trial and try to conclude the same within a period of six months. It has been submitted by learned counsel for the petitioner that six months period has already expired and other coaccused of this case has already been enlarged on bail and though it is alleged that 164 bottles of liquor were recovered, however, nothing has been recovered from the conscious possession of the petitioner rather the recovery was from the Tempo. Further he has been in custody since 25.01.2017.
Earlier a report was called for from the court below, form which, it appears that trial undertakes to conclude the trial by
Patna High Court Cr.Misc. No.56529 of 2017 (3) dt.10-01-2018 2/2 February, 2018.
In such view of the matter, I am not inclined to release the petitioner on bail, however, this application is disposed of with direction to the trial court that if the trial is not concluded within the aforesaid period, he may release the petitioner on bail to his own satisfaction.
