2. Petitioner seeks regular bail in connection with Mahila P.S. Case No. 64 of 2023 registered for the offences punishable under Sections 376/323/504/506/34 of the Indian Penal Code and Section 4/6 of the POCSO Act.
3. Learned counsel appearing on behalf of the informant submitted that the informant has been blessed with a child and biological father of child is the petitioner. However,
Patna High Court CR. MISC. No.49340 of 2024(2) dt.29-11-2024 2/2 learned counsel appearing on behalf of the petitioner submitted that the allegation as contained in the FIR is false and the child also don't belong to the petitioner.
4. In view of the disputed fact, I don't find any merit in the bail application. However, the petitioner may avail remedy before competent civil court, as well as, the learned District Court, where the criminal prosecution is pending.
5. The bail application, accordingly, stands disposed of.
