Petitioner seeks pre-arrest bail in Laheria Sarai P.S.Case No.297 of 2018 registered under Sections 379 of the I.P.C.
Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that when the motor cycle of the informant was lifted from near the southern gate of the civil court, Darbhanga then he lodged the present case i.e., Laheria Sarai P.S. Case No.297 of 2018 on 9.6.2018 against unknown.
Learned counsel for the petitioner further submits that the police recovered motor cycle in opening condition near the road as detailed in para 46 of the case diary. Later on, on
Patna High Court Cr.Misc. No.72133 of 2018(4) dt.30-01-2019 2/2 suspicion one Shankar was apprehended who disclosed the name of this petitioner as his associate having hand in lifting the motor cycle. Except that nothing has been collected by the I.O. against the petitioner. Further submission is that though the petitioner is accused in two other cases, as detailed in para 3 of the petition, but he is on bail.
Having considered the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the learned court below within four weeks from today be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Darbhanga, in Laheria Sarai P.S. Case No.297 of 2018 subject to the conditions as laid down under Section 438(2) of Cr.P.C. and further condition that one surety must be of his own relative.
