JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-01-2016 Heard learned counsels for the petitioners and the State.

The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 406, 420, 467, 468, 471, 368 of the Indian Penal Code. Prosecution case is that co-accused Arun Chaurasia and Gajendra Kumar came to the house of the complainant and persuaded him to purchase Bolero vehicle being registration no. BR9M-2454 when the informant paid Rs.1,40,000/- on assurance that for rest of the amount loan will be sanctioned in favour of the informant. Subsequently, informant fall ill and after recovery he paid Rs.3,62,000/- but the petitioner and three others seized the vehicle, in question along with a bag containing Rs.72,600/-. It is submitted by learned counsel for the petitioner that

Patna High Court Cr.Misc. No.2971 of 2016 (3) dt.21-01-2016 2/2 as per own admission of the informant he made default in making repayment of the loan amount and petitioner being recovery agent of the UKO bank in pursuance to the direction of the bank seized the vehicle, in question, after the default being made by the informant. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the nature of accusation, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Begusarai in connection with Begusarai Town P.S. Case No.512/2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
