ANJANA MISHRA ORAL ORDER 06-10-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Khaira P.S. Case No.70 of 2016 for allegedly having committed the offence under Sections 341, 323, 307, 504, 506/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that admittedly, the dispute arose out of a quarrel between the children of the two villages, who were playing together. Elders intervened, as a result of which there was further fight and the occurrence as alleged took place. Admittedly, there is no premeditation. Moreover, learned counsel for the petitioner submits that the main accused, namely, Benju Singh @ Munna
Patna High Court Cr.Misc. No.40140 of 2016 (3) dt.06-10-2016 2/2 Kumar Singh, who is alleged to have assaulted the informant with cricket bat, has been extended the privilege of anticipatory bail in Cr.Misc. No.33105 of 2016, vide order dated 22.09.2016.
Considering the aforementioned facts and circumstances, the nature of allegations and also because the petitioner has no criminal antecedents, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui, in connection with Khaira P.S. Case No.70 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
