Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 324, 307, 379, 504 of the Indian Penal Code. It is alleged against the petitioner that he assaulted with Dab on the head of the informant.

It is submitted by the learned counsel for the petitioner that in the background of petty dispute the accusation has been levelled. There is no accusation of repeating the blow and injury appears to be simple in nature. Moreover, there is counter version of the occurrence. Though, the fardbeyan of the petitioner's side was recorded earlier, but police maliciously subsequently registered the First Information Report of the petitioner's side. Statement has been made in

Patna High Court Cr.Misc. No.28 of 2016 (2) dt.05-01-2016 para-3 of the petition that petitioner has no criminal antecedent.

The aforesaid facts constitute ground for consideration of prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Bheldi P.S. Case No. 153 of 2015, pending in the court of learned Sri Arun Kumar Singh, J.M., Ist Class, Saran at Chhapra. With this observation this application is disposed of.
