Petitioner, already in custody, seeks bail in connection with Murliganj P.S. Case No.121 of 2017, registered under Sections 302, 201 and 34 of the Indian Penal Code.

Allegation is that the dead body of Rahul Kumar was found thrown in a field after killing him.

Learned counsel for the petitioner submits that the FIR is against unknown. However, later it transpired that the deceased had love affair with the daughter of Radha Kant Yadav and it was an owner killing and except the disclosure of the name of the petitioner in the confessional statement of Radha Kant Yadav and so called confessional statement of the petitioner, there is no other material against him and the petitioner had only

Patna High Court Cr.Misc. No.54375 of 2017(5) dt.29-01-2018 2/2 three criminal antecedents under Sections 498A of the Indian Penal Code as well as under the SC/ST Act and the petitioner is in custody since 05.06.2017.

Having considered the said facts and circumstances, petitioner Md. Parwez Alam is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Murliganj P.S. Case No.121 of 2017.
