Mr. Arun Kumar Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 20-11-2024 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in connection with Dhangai P.S. Case No.72 of 2023 instituted under Sections 384, 386, 387 and 420 of the Indian Penal Code.

3. As per prosecution case, the petitioner had taken Rs.2,000/- from one Sangeeta Devi and six other co-villagers in the name of making rashan card.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He further submits that the complainant and the petitioner are co-villagers and due to Panchayat Election and political rivalry, this case has been lodged. The husband of said Sangeeta Devi is a Ward Member and the allegation against the petitioner

Patna High Court CR. MISC. No.53084 of 2024(4) dt.20-11-2024 2/2 is vague. It is also submitted by filing a supplementary affidavit that the complainant Sangeeta Devi along with others have already filed an affidavit stating that they have received the said amount and they have no objection against the bail petition of the petitioner. The petitioner has no criminal antecedent and he undertakes to cooperate in the investigation.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Sherghati, Gaya in connection with Dhangai P.S. Case No.72 of 2023 subject to the conditions as laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
