JUSTICE ARUN KUMAR ORAL ORDER 10-01-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Katra PS Case No. 66 of 2017 registered under Sections 25(1-B)A; (AA); (AAA); 26 &35 of the IPC.
The allegation in brief is that the police during vehicle checking recovered one country made revolver and one live cartridge from the possession of the petitioner.
Learned Counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 15.7.2017. Chargesheet has been submitted in this case.
Having considered the said facts and circumstances, the petitioner, namely, Md. Chand is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub Judge XVth cum ACJM IXVth, Muzaffarpur, in connection with Katra PS Case No. 66 of 2017 with the condition that one of the bailors must be a close family member of the petitioner and the petitioner is directed to be physically present on each date in the trial court and absence on two consecutive dates except on medical grounds shall be liable for cancellation of his bail bonds.
