JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 11-01-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Dorignaj P. S. Case No. 75 of 2015 registered under Sections 341, 342, 323, 324, 307, 379 of the Indian Penal Code. It has been contended that on 28.08.2015 at 11.00 a.m. the informant Sanjiv Kumar entered in the house of co-accused Sanjay Singh while his daughter was alone in the house and was watching T.V. and outraged her modesty. On alarm, the son of Sanjay Singh, namely, Aditya Kumar reached there and raised protest upon which the informant Sanjiv Kumar attacked upon him with knife causing him injury for which Doriganj P.S.Case No. 74 of 2015 was instituted on 28.08.2015. No.661 of 2016 (2) dt.11-01-2016 2/2 occurrence took place in village Manupur Jahangir falling within Doriganj police station but the matter was not reported to the local police at Doriganj Police Station and the informant has recorded his fardbeyan in the PMCH, Patna after one day without mentioning the cause of delay pursuant to which Doriganj P. S. Case No. 75 of 2015 was instituted on 29.08.2015. Regard being had to the facts and circumstances of the case, in the event of arrest or surrender before the court below within six weeks from today, the petitioner Vinay Singh is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. 7th, Saran, Chapra in connection with Doriganj P.S. Case No. 75 of 2015, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
