The petitioner seeks regular bail in connection with Halsi P.S. Case No. 117 of 2017, registered for the offence punishable under Sections 304(B) and 201 of the Indian Penal Code.
The allegation in the present case is regarding recovery of dead body of the victim lady, who is the wife of the petitioner herein from a well and it is alleged that she was tortured and killed on account of non fulfillment of the demand for dowry.
The learned senior counsel for the petitioner has submitted that the postmortem report would bear out that there is no external injury and the death of the victim lady
Patna High Court Cr.Misc. No.70786 of 2018(3) dt.11-01-2019 2/2 can be said to be on account of suicide committed by her. It is submitted that the petitioner was working at a place outside the village and was not present during the relevant time, hence, he is not responsible for the alleged death of his wife. Lastly, it is submitted that the petitioner is having a clean antecedent and he is languishing in custody since 02.06.2018. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate III, Lakhisarai in connection with Halsi P.S. Case No. 117 of 2017.
