The petitioner apprehends arrest in connection with Barauni (Refinery O.P.) P.S. Case No. 247 of 2016 dated 25.06.2016 instituted under Sections 363/366(A)/34 of the Indian Penal Code. The allegation against the petitioner and other family members is of kidnapping the minor daughter of the informant with a view to marry her.

Learned counsel for the petitioner submits that he and the girl had become friendly and she on her own free will has accompanied him to various places but there was no physical relationship between them. It is submitted that the girl has also given her statement before the Court under Section 164 of the Code of

Patna High Court Cr.Misc. No.44074 of 2016 dt.17-10-2016 2/2 Criminal Procedure, 1973 in which she has given details where she went and has clearly stated that she has gone on her own free will and the petitioner had not done any wrong act with her. Learned A.P.P. opposes the prayer for anticipatory bail.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in Barauni (Refinery O.P.) P.S. Case No. 247 of 2016, subject to the conditions laid down in Section 438 (2) of the Code of Criminal Procedure, 1973.
