====================================================== CORAM: HONOURABLE MR. JUSTICE MADHURESH PRASAD ORAL ORDER 21-02-2018 Heard counsel for the petitioners, the State and the informant.

Petitioners are accused in a case registered for offence under sections 147, 148, 149, 341, 323, 324, 307, 504 and 302 IPC.

Submission of the petitioners is that the petitioners, who have no antecedent, have falsely been implicated in this case. The informant, who is deceased in the case, has not attributed any overt act against the petitioners. He has only alleged that petitioner no. 1 exhorted and petitioner no.2 caused injury to his she goat. Petitioners are in custody since 12.9.2017 and 25.9.2017 respectively.

Counsel for the informant opposes the prayer for bail. Considering the aforesaid submissions, prayer for bail of

Patna High Court Cr.Misc. No.63456 of 2017 (3) dt.21-02-2018 the petitioners is allowed. Let both the petitioners, mentioned above, be released on bail on furnishing bail bond of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Aurangabad in Navinagar Police Station Case No. 187 of 2017 on the following conditions:- (a) One of the bailors will be a close relative of the petitioners who will give an affidavit giving genealogy as to how they are related with the petitioners. The bailor will also undertake to inform the Court if there is any change in the address of the petitioners and (b) The Petitioners will be well represented on each date and if they fail to do so on two consecutive dates, their bail will be liable to be cancelled.
