The petitioner seeks bail in connection with Allouli P. S. Case No.301 of 2020, instituted for the offences under Sections 30(a) of the Bihar Prohibition and Excise Act, 2018. The learned counsel for the petitioner submits that the petitioner is in custody since 07.07.2021, he is a person with clean antecedents, charge-sheet has been submitted in this case. Allegation is of recovery of 211.62 litre of liquor from the house of Shiv Shankar Yadav.

It is submitted that petitioner was not arrested from the spot and his name was disclosed by the Chaukidar, who was on an inimical term with him alleging that he fled away on seeing the police.

Considering the fact that the petitioner is in custody since 07.07.2021, he is a person with clean antecedents, chargesheet has been submitted in this case and was not arrested from the spot, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Khagaria in connection with Allouli P. S. Case No.301 of 2020. The application stands allowed.
