====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 07-08-2025 Heard learned counsel for the petitioner and the State.
2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 279, 337, 341, 323, 324, 307, 379, 504 and 506/34 of the Indian Penal Code.
3. The case of the prosecution is that the petitioner along with other F.I.R. named accused persons arrived at the house of the informant and started searching the nephew of the informant. It is further alleged that this petitioner, who was armed with sword, assaulted on the neck of the informant which hit near the eye. It is further alleged that co-accused Shambhu Ray assaulted with lathi on the head of the informant.
4. Learned counsel for the petitioner submits that both parties are co-villagers and due to petty dispute over motorcycle collision, an altercation took place between them in which both

Injury allegedly caused by the petitioner on the eye of informant is opined to be simple in nature. It is further submitted that similarly situated co-accused persons have already been granted anticipatory bail by co-ordinate Bench of this Hon'ble Court vide order dated 04.08.2025 passed in Cr. Misc. No. 45756 of 2025.
5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering backdrop of the case and simple injury, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran, Motihari in connection with Kalyanpur P. S. Case No. 335 of 2023, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
