Petitioner apprehends his arrest in Complaint Case No.310 of 2017 for the offences allegedly committed by the petitioner under Section 498A of the Indian Penal Code and under Section 4 of the Dowry Prohibition Act. Learned counsel for the petitioner submits that the complainant herself alleged that firstly she fell in love with the petitioner and when the complainant went to the house of the petitioner she found that the petitioner has got his first wife. Learned counsel for the petitioner drew the attention of the Court on the statement made by the complainant in para 9 of the complaint petition and submits that the complainant has

Patna High Court Cr.Misc. No.74751 of 2018(4) dt.22-01-2019 2/2 disclosed that she was earlier married and her first husband deserted her but she fell in love and solemnized marriage with the petitioner.

Considering the facts aforesaid and the fact that the complainant herself disclosed this fact that she had earlier married but deserted by her first husband and later on she fell in love with the petitioner, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of this order be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Nawada in connection with Complaint Case No.310 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C.
