This application for anticipatory bail arises out of Govindpur P.S. Case No. 19 of 2019 for the offence under Section 384 of the Indian Penal Code.

It has been stated in paragraph 3 of the application that the petitioner has criminal antecedent inasmuch as he is an accused in commission of offence under Section 302 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner has submitted that the petitioner has been implicated merely on the basis of confessional statement of the co-accused. Considering the seriousness of the offence and criminal antecedent of the petitioner, I am not inclined to grant him privilege of anticipatory bail. This application is accordingly rejected.

No.40961 of 2019(2) dt.03-07-2019 2/2 The petitioner is directed to surrender before the Court below within a period of four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered by the learned Court below on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
