2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 341, 324 and 302 of the I.P.C.

3. The case of the prosecution, in short, is that, the son of the informant, namely, Chandan Ram, was killed by some unknown miscreants by stabbing.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted that from perusal of the FIR it is evident that there is no name of any accused person in the FIR but in the restatement, the informant has developed the story and has stated that there was illicit relationship between

This statement of the informant has been reiterated by his family members. It has further been submitted that there is no any material to suggest that the petitioner was having illicit relation with the cousin sister-in-law of the deceased even the statement of cousin sister-in-law is also not recorded by the police. The petitioner has clean criminal antecedent as stated in paragraph no. 3 of the bail petition. Moreover, the petitioner is languishing in judicial custody since 16.03.2025.

Learned APP appearing for the State has vehemently opposed the prayer of regular bail and submitted that the informant, in his re-statement, has stated that the petitioner was having illicit relationship with cousin sister-inlaw of the deceased and when Chandan Ram arrived from Pune, he came to know about this relationship and there has been hot talk on this point between the deceased and the petitioner. The deceased has told the informant that the petitioner has threatened him of dire consequences.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with

Patna High Court CR. MISC. No.43784 of 2025(5) dt.02-12-2025 3/3 Garkha P.S. Case No. 330 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M.-1st Class, Saran at Chapra/concerned Court below.
