Petitioner, who is in custody, seeks bail in a case registered for the offence punishable under Sections 341, 448, 324, 325, 307, 379 and 34 of the Indian Penal Code. Informant has alleged in her fardbeyan that on 13.07.2018 at 11:00 PM while she was sleeping on the roof of her house, petitioner and one unknown miscreant entered and asked as to who was sleeping and when she asked the reason then it is alleged that Ranjeet Rai (Petitioner) inflicted a knife blow on her abdomen and in order to save herself she jumped from the roof causing fracture injury and the other unknown miscreant snatched golden chain from her neck. Earlier also, petitioner had moved this Court for grant

Patna High Court CR. MISC. No.3351 of 2021(2) dt.24-02-2021 2/3 of regular bail which was rejected vide Annexue 1 with liberty to renew his prayer for bail after completing one year in jail custody.

It has been submitted on behalf of the petitioner that he is innocent and has falsely been implicated in this case due to village politics. As a matter of fact the petitioner and informant are neighbours but due to different religion, name of the petitioner has been dragged in this case. It is further contended that due to falling from the roof, she sustained injury over her person. Petitioner has no criminal antecedent and he is in custody since 25.07.2019.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 20,000/- with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Sess. Tr. No. 224 of 2020 arising out of Parsa P. S. Case No. 137 of 2018 with following conditions:-

(1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2) Petitioner shall co-operate in the trial and shall be properly represented on each and every date

Patna High Court CR. MISC. No.3351 of 2021(2) dt.24-02-2021 3/3 fixed by the court and shall remain physically present as directed by the Court and his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the court below.

(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
