JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 02-07-2019 Learned counsel for the petitioner is permitted to make necessary correction in para 1 of this application. Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Sirdalla (Meskaur) P.S. Case No. 49 of 2016 for the offence under Sections 272, 273 of the Indian Penal Code and Section 47(a) of the Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 29.04.2019. He further submits that in the instant case total 35 litres of liquor was seized.

Considering the fact that the petitioner has got no criminal antecedent, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/-

Patna High Court CR. MISC. No.40835 of 2019(2) dt.02-07-2019 2/2 (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II-cum- Special Judge, Excise Act, Nawada in connection with Sirdalla (Meskaur) P.S. Case No. 49 of 2016.
