The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Begusarai Mufassil P.S. Case no. 64 of 2021 instituted for the offence under Sections 409, 420, 120B and 34 of the Indian Penal Code.

As per allegation in the FIR, petitioner is Panchayat Rojgar Sewak and irregularities have been found in several yojna and a direction was given to refund the money amounting to Rs. 4772 in Yojna No. 06/08-08.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no

By letter no. 77 dated 27.1.2021, D.D.C. directed the Programme Officer Manrega Sadar, Begusarai to realize the money from the petitioner and accordingly, petitioner has deposited a sum of Rs. 82552.15 in the concerned account number, which is Annexure-1 to this petition also the same has also been annexed with FIR itself by the informant. . Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Begusarai Mufassil P.S. Case no. 64 of 2021., he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Begusarai subject to the conditions as laid down under section 438(2) of the Cr.P.C.
