2. The petitioner apprehends his arrest for the offences alleged under Sections 115(2), 126(2), 109, 324(1), 352, 351(2), 351 and 3(5) of the BNS registered in connection with Manjhi P.S.Case No. 35 of 2025.

3. As per allegation, while the informant along with one Prabhakar Singh was on way to market, the accused persons, including the petitioner, waylaid them. In the process of quarrel, co-accused Ajit Kumar Sngh assaulted the informant on his head, by reason of which he became injured. Then coaccused Shivam Kumar Singh assaulted Prabhakar Singh by means of iron rod on his neck, as a result of which he became unconscious. Thereafter the petitioner also tried to assault the

Patna High Court CR. MISC. No.43365 of 2025(5) dt.10-12-2025 2/2 informant and Prabhakar Singh, but with the help of the villagers, they were saved.

4. The learned counsel for the petitioner has submitted that specific allegation of assault is against co-accused Ajit Kumar Singh and Shivam Kumar. The allegation against the petitioner is that he attacked the informant but was saved. The learned counsel further submitted that the FIR itself shows that the petitioner did not cause any kind of injury to the informant or any other person.

Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-XI, Saran at Chapra in connection with Manjhi P.S.Case No. 35 of 2025, subject to the condition as laid down under Section 438(2) CrPC/482(2) of the BNSS.
