The petitioners apprehend their arrest in Nokha P.S. Case No. 181/2016, registered for the offences punishable under Sections 406, 420 and 506 of the Indian Penal Code and Section 138 of the Negotiable Instruments Act.
The informant alleged that he gave paddy of worth Rs. 7,54,712/- to Mahendra Prasad the owner of Mahajan Rice Mill and his sons. They issued five cheques, but all the five cheques were dishonoured.
Learned counsel for the petitioner submits that petitioner have no manner of concern with the business of the Mahajan Rice Mill. Petitioners are sons of Mahendra Prasad and
Patna High Court Cr.Misc. No.55663 of 2016 (2) dt.12-01-2017 2/2 that is why they have falsely been implicated in the case. Petitioners did not issue any cheque in favour of the informant. Considering the facts aforesaid, the petitioners above-named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Sasaram Rohtas in connection with Nokha P.S. Case No. 181/2016, G.R. No. 1735/2016 subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
