The petitioner is apprehending his arrest in a case registered under Sections 420, 467, 468 and 471 of the Indian Penal Code.

Allegation is that the petitioner has committed cheating and forgery in written examination for appointment of constable. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been made accused due to mistake of fact. For the similar facts different F.I.Rs. were instituted against the different candidates. It has been submitted that the other candidates have

Patna High Court Cr.Misc. No.50847 of 2016 (2) dt.02-12-2016 2/2 been granted anticipatory bail. One of the order of the co-ordinate Bench has been placed and relied upon vide Cr.Misc.No.23791 of 2016.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Sanjay Priya, J.M., 1st class, Sitamarhi in connection with Dumra P.S. case No.321 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
