The petitioner has prayed for bail in a case registered for the offence punishable under sections 8, 15, 17, 18, 25 and 29 of NDPS Act.

Prosecution case relates to recovery of 14.10 kg. Doda powder, which was being transported by a truck, of which petitioner was driver.

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has been falsely implicated in this case. During investigation, no cogent material has come against the petitioner. Total 14.10 kg doda powder has been recovered from the petitioner, whereas commercial quantity is

Patna High Court CR. MISC. No.45019 of 2022(3) dt.16-01-2023 2/2 50 kg.. The alleged recovery is much less than the commercial quantity. Petitioner is languishing in custody since 06.06.2022. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned 1st Additional District and Sessions Judge-cum-Special Judge (NDPS), Aurangabad in connection with Madanpur P.S. Case No. 283 of 2022.
