JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-01-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341,323,324,308,379,504 and 506/34 of the Indian Penal Code. The prosecution case is that six-years-old-nephew of the informant Nandlal Ram touched the brick of Bindeshwari Ram then wife of Poshan Ram started abusing. When the informant protested, the accused persons surrounded the informant when petitioner no. 2 Arun Ram caused injury with Khanti as a result he received injury and fell down.

It is submitted by the learned counsel for the petitioners that the accusation of assault is not against petitioner no. 1 and for

Patna High Court Cr.Misc. No.3363 of 2016 (2) dt.21-01-2016 2/2 the petty dispute the accusation has been levelled. Considering the aforesaid facts, let the above named petitioner no. 1 be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Banka, in connection with Dhoraiya (Dhankund) P.S. Case No.193 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C. So far as petitioner no. 2 is concerned, let the learned court below consider his the prayer for regular bail if he surrenders within six weeks from today in connection with the aforementioned case pending in the court of learned J.M. Ist Class, Banka. This application is disposed of with the aforesaid observation/direction.
