JUSTICE RAKESH KUMAR ORAL ORDER 04-12-2017 Heard Sri Shiva Shankar Sharma, learned counsel for the petitioner and learned Additional Public Prosecutor. The sole petitioner, who is in custody since 14.09.2017 in connection with Katra P.S. Case No. 86 of 2017 registered for the offence under section 30(a) , 36/38 of the Bihar Prohibition and Excise Act , 2016 and under section 271 and 272 of the Indian Penal Code ,1860 has prayed for grant of bail. It was submitted by learned counsel for the petitioner that save and except confessional statement of the co -accused that too before Police there is no material to connect the petitioner in the present case. The submission made by learned counsel for the petitioner was not disputed by learned Additional Public Prosecutor.

In view of the nature of accusation as well as the fact that

No.56376 of 2017(2) dt.04-12-2017 2/2 petitioner's name has come only on confessional statement of the co-accused, which was made before Police and period of custody, let the petitioner Ritesh Kumar @ Bipin be enlarged on bail on furnishing bail bond of Rs. 10,000/- ( ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Muzaffarpur / concerned court in connection with Katra P.S. Case No. 86 of 2017. (Rakesh Kumar, J) praful/- U T
