The petitioner has preferred this application for grant of regular bail in a case registered under sections 461 and 379 of the Indian Penal Code.

As per the prosecution case, Rs. 5 lacs in cash was stolen from the shop of the informant. He states that on inquiry it transpired that the petitioner had given effect to such an occurrence in the past and therefore the suspicion. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. No material has transpired in course of investigation to connect the petitioner with the alleged crime. No incriminating article has been recovered from the possession of the petitioner. The

Patna High Court CR. MISC. No.53482 of 2021(3) dt.27-04-2022 2/2 alleged amount of Rs. 1000/- recovered from the petitioner's possession is in no way connected with the stolen amount. The petitioner is in custody since 30.6.2021 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the material that has transpired in course of investigation, the petitioner having remained in custody for 9 months and not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with G.R. no. 1613 of 2021 (arising out of Shambhuganj P.S. Case no. 148 of 2021) on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-IV, Banka.
