The petitioner seeks regular bail in connection with Madhepura O.P. Bharahi P.S. Case No. 706 of 2017 for the offences punishable under Sections 30(a) and 37(b) of the Bihar Prohibition and Excise Act, 2016.

The petitioner is said to have been apprehended in a drunken condition and from search of his house, 6 liters of illicit mahua liquor was recovered.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, he has a clean antecedent and he is in custody since 13.10.2017. Considering the nature of accusation, the period of

No.830 of 2018 (2) dt.18-01-2018 2/2 custody already undergone and the fact that the petitioner has a clean antecedent, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-3rd -cum Special Judge (Excise), Madhepura, in connection with Madhepura (Bharahi) P.S. Case No. 706 of 2017.
