1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in a case registered for the offences punishable under Sections 409 and 420 of the Indian Penal Code and Section 7 of the Essential Commodities Act.

3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent.

4. The informant alleges that the PDS shop of the petitioner was inspected and in the stock register 444.63 quintal rice and 169.06 quintal wheat were mentioned but in reality only 14 quintals of rice and 4 quintals of wheat were found, thus, it is alleged that petitioner misappropriated 412 quintal 35 Kg of rice and 160 quintal 99 Kg of wheat and sold it in the black market.

5. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant without holding a proper inquiry. It is further submitted that a new godown was under construction as such the wheat and the rice were kept in the godown which was under construction. It is further submitted that petitioner is in custody since 29.04.2024 and charge-sheet has been submitted.

6. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

7. Considering the submissions aforesaid, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Mushrigharari P.S. Case No. 23 of 2024.
