This application for anticipatory bail arises out of Complaint Case No. C.I. 2045 of 2018, Tr. No. 4016 of 2018, disclosing the offence under Section 498-A of the Indian Penal Code.
It is alleged in the complaint petition that the in-laws of the complainant including her husband, who is petitioner in this case, had been demanding dowry and had been torturing therefor. It appears from the contents of the complaint petition, statement of the complainant on SA and statements made in the present application that matrimonial discord is possibly the reason behind lodging of the complaint case.
Patna High Court CR. MISC. No.44384 of 2019(4) dt.30-09-2019 2/2 Considering the facts and circumstances, this application is allowed. Let the petitioner, above-named, in the event of his arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned Additional Chief Judicial Magistrate,-Xvth, Vaishali at Hajipur in Complaint Case No. C.I. 2045 of 2018, Tr. No. 4016 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the Police/ Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
