The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 147, 148, 149, 323, 435, 436, 307, 504, 506 of the Indian Penal Code, Section 27 of the Arms Act and Section 3 (iv) (v) (x) 3 (2) II (v) of SC/ST Act. It is contended that in Title Suit No.119/1992, a judgment and decree was passed in favour of the petitioners and an attempt was made to dispossess them by the other sides, as such, they have falsely been implicated in the present case. Patna High Court Cr.Misc. No.58343 of 2015 (2) dt.27-01-2016 2/2 that about twenty accused persons have already been granted anticipatory bail by a Bench of this Court vide order dated 13.10.2015 passed in Cr. Misc. No.44334/2015. Having regard to the facts and circumstances of the case, let the petitioners, namely, Vinay Rai, Pappu Rai, Pancham Rai, Munna Rai, Shambhu Rai and Sanjay Rai be released on bail in the event of their arrest/surrender before the court below within a period of six weeks from today in connection with Raghopur P.S. Case No.117/2014, on furnishing bail bonds of Rs.10,000 (Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
