JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-07-2019 Heard learned counsel for the petitioner, learned counsel for the informant and learned counsel for the State. This application, for grant of anticipatory bail, arises out of Danapur P.S. Case No. 164 of 2019, disclosing offences under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

At the very outset, learned counsel for the informant has submitted that in this case process under Section 82, 83 Cr.P.C. has already been exhausted against the petitioner. Having heard the parties, in view of the above fact, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather petitioner, if so desire, may surrender before the court below and make prayer for regular bail and if any such application is filed, the court below will dispose of the same on
